FOR AN ACT ENTITLED, An Act to
require the use of safety seat belts by passenger vehicle
occupants under eighteen years of age.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 32-37 be amended by adding thereto a NEW SECTION to read as follows:

Section 1. That chapter 32-37 be amended by adding thereto a NEW SECTION to read as follows:
The operator of any passenger vehicle transporting a child who is at least five and under
eighteen years of age on the streets and highways of this state shall assure that the child is
wearing a properly adjusted and fastened safety seat belt system at all times when the vehicle is
in motion. A violation of this section is a petty offense.
Section 2. That chapter 32-37 be amended by adding thereto a NEW SECTION to read as follows:

highway in this state, who is at least fourteen and under eighteen years of age, shall wear a
properly adjusted and fastened safety seat belt system at all times when the vehicle is in motion.
A violation of this section is a petty offense.
Section 3. That § 32-37-2 be amended to read as follows:
