FOR AN ACT ENTITLED, An Act to repeal the requirement for school districts to have certain
teaching certificates on file.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That § 13-43-5 be amended to read as follows:
13-43-5. A teacher may sign a contract only upon exhibition of a valid certificate to teach the courses and grades in the school contemplated under thesaid contract and to qualify such
the school for accreditation. A person shall be is eligible to sign a contract if he the person is
completing academic training which would qualify him the person for issuance or renewal of
a teaching certificate. However, if a certificate is not issued prior to the time for performance
of the contract, such the contract shall thereafter be is thereafter void. Such certificate or a copy
thereof shall be filed in the administrative office of the school district prior Prior to making
payment under the contract, the validity of the certificate shall be verified through the
Department of Education's public online certification database.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
