FOR AN ACT ENTITLED, An Act to
provide for implied covenants of good faith and fair
dealing in certain employment contracts.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That § 60-4-4 be amended to read as follows:
60-4-4. An employment having no specified term may be terminated at the will of either party on notice to the other, unless otherwise provided by statute. However, there is an implied covenant of good faith and fair dealing between an employer and employee in any employment relationship.
