AN ACT
ENTITLED, An Act to
continue to allow investigative materials to be confidential during the
investigative phase and to allow the material to be obtained by parties to a complaint after a
probable cause determination is made.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 20-13 be amended by adding thereto a NEW SECTION to read as follows:

Prior to the issuance of a probable cause determination under
§
20-13-32, information and
materials regarding a charge of discrimination obtained by an investigating official are confidential.
Notwithstanding
§
§
1-27-29 to 1-27-32, inclusive, after the issuance of a probable cause
determination and upon receipt of a written request and payment of costs for copying, all
investigatory materials may be disclosed to the parties or their counsel of record.
