ENTITLED, An Act to  require the recalculation of the allocation for the disability levels in the state aid to special education formula.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
     Section  1.  That chapter 13-37 be amended by adding thereto a NEW SECTION to read as follows:

     In fiscal year 2004 and every three years thereafter, the Department of Education and Cultural Affairs shall recalculate the amounts of the allocations for the disability levels defined in §  13-37-35.1. The recalculation shall be based on statewide average expenditures as reported to the Department of Education and Cultural Affairs in school district annual reports by disability for the previous three school fiscal years.
