FOR AN ACT ENTITLED, An Act to
revise certain provisions and to increase certain penalties
regarding the disturbance of a school.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That § 13-32-6 be amended to read as follows:
13-32-6. A person, whether pupil or not, who intentionally disturbs a public or nonpublic school when in session or who intentionally interferes with or interrupts the proper order or management of a public or nonpublic school by acts of violence, boisterous conduct, or threatening language, so as to prevent the teacher or any pupil from performing his or her duty, is guilty of a

misdemeanor.
Section 2. That chapter 13-32 be amended by adding thereto a NEW SECTION to read as follows:

Section 2. That chapter 13-32 be amended by adding thereto a NEW SECTION to read as follows:
Any person, whether pupil or not, who intentionally disturbs a public or nonpublic school
when in session or who intentionally interferes with or interrupts the proper order or
management of a public or nonpublic school by terroristic or bomb threats, whether intended to
be carried out or not, so as to prevent the teacher or any pupil from performing his or her duty
is guilty of a Class 6 felony.
