FOR AN ACT ENTITLED, An Act to
clarify that certain political contributions to ballot
question committees from association dues and funds are permitted.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That § 12-25-2 be amended to read as follows:
12-25-2. No candidate, candidate's committee, political action committee, or political party committee may receive any contribution except from an individual, political action committee, or a political party. No corporation or association may contribute or attempt to contribute any valuable consideration to any candidate, committee, or political party except a ballot question committee.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:

12-25-2. No candidate, candidate's committee, political action committee, or political party committee may receive any contribution except from an individual, political action committee, or a political party. No corporation or association may contribute or attempt to contribute any valuable consideration to any candidate, committee, or political party except a ballot question committee.
Associations may contribute any valuable consideration out of funds contributed for the
purpose of making political contributions but may not make contributions
to any candidate,
committee, or political party
out of dues or treasury funds.
Any association contributing to a
ballot question committee shall comply with all applicable state and federal laws.
A violation of this section is a Class 2 misdemeanor.
