FOR AN ACT ENTITLED, An Act to
require municipalities to be responsible for sidewalks
located on property owned by the municipality.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 9-46 be amended by adding thereto a NEW SECTION to read as follows:

Section 1. That chapter 9-46 be amended by adding thereto a NEW SECTION to read as follows:
Notwithstanding the provisions of chapter 9-46 or any other law or ordinance, if a
municipality owns the property on which a sidewalk is located, the municipality is responsible
for maintaining, repairing, replacing, and constructing such sidewalk.
