FOR AN ACT ENTITLED, An Act to
prohibit the filing of false financing statements.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 22-11 be amended by adding thereto a NEW SECTION to read as follows:

Section 1. That chapter 22-11 be amended by adding thereto a NEW SECTION to read as follows:
No person may file a financing statement with the secretary of state knowing that the debtor
did not authorize the filing of that financing statement. A violation of this section is a Class 1
misdemeanor.
