FOR AN ACT ENTITLED, An Act to
require a school board to notify the parent or guardian
of each student being taught by certain teachers.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 13-43 be amended by adding thereto a NEW SECTION to read as follows:

Section 1. That chapter 13-43 be amended by adding thereto a NEW SECTION to read as follows:
If a school board assigns an uncertified teacher to teach the same course or grade for more
than fifteen consecutive school days during the same school year, the superintendent of the
school district shall provide written notice of the assignment to the parent or guardian of each
student in that course or grade. If a school board assigns a certified teacher to teach a course or
grade for which the teacher is not certified for more than fifteen consecutive school days during
the same school term, the superintendent shall provide written notice of the assignment to the
parent or guardian of each student in that particular course or grade. The superintendent shall
provide the notice required by this section not later than the fifteenth consecutive school day
following the assignment. The school board shall retain a copy of any notice provided under this
section and make it available to the public upon request.
