FOR AN ACT ENTITLED, An Act to
prohibit unsolicited gaming e-mail and to provide a
penalty therefor.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 22-25 be amended by adding thereto a NEW SECTION to read as follows:

Section 1. That chapter 22-25 be amended by adding thereto a NEW SECTION to read as follows:
No person may send or cause to be sent to any South Dakota e-mail address any commercial
e-mail message soliciting the addressee to engage in internet gaming or advertising the
availability of internet gaming unless the addressee has specifically requested such e-mail. A
violation of this Act is a petty offense and subjects the violator to a fine not to exceed three
hundred fifty dollars for each message sent and received in violation of this section.
