FOR AN ACT ENTITLED, An Act to
provide distributions from certain funds.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. Beginning on July 1, 2002, the state treasurer shall transfer five million dollars, or so much as may be available, from the investment income on the education enhancement trust fund to the general fund as soon as it is practicable after July first each year. The state treasurer shall then transfer the same amount from the general fund to the tobacco prevention and reduction trust fund created pursuant to § 34-46-12. If such amount transferred to the tobacco prevention and reduction fund is less than five million dollars, then the state treasurer shall transfer the difference, or so much thereof as may be available, from the remaining investment income on the youth-at-risk education trust fund and the people's interest fund.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:

The money deposited in the tobacco prevention and reduction fund pursuant to this Act shall
be used to implement elements of the tobacco prevention and reduction plan as described in
§
34-46-10 each fiscal year.
