AN ACT
ENTITLED, An Act to authorize a carryover of the fiscal year 2010 state aid to special education
appropriation to fiscal year 2011.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. Notwithstanding the provisions of §§ 4-8-19 and 13-37-40, any unencumbered funds appropriated from the state general fund by section 11 of chapter 22 of the 2009 Session Laws for state aid to special education, equal to an amount necessary to meet the federal maintenance of effort requirement, shall be carried forward to fiscal year 2011.
Section 2. This Act is effective June 28, 2010.
