         FOR AN ACT ENTITLED, An Act to  add two nonvoting student members to the South Dakota Board of Education.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
     Section  1.  That § 1-45-6.1 be amended to read as follows:
     1-45-6.1.   There is created within the Department of Education the South Dakota Board of Education. The South Dakota Board of Education shall consist of nine voting members and two nonvoting student members, one high school junior and one high school senior . The All members shall be appointed by the Governor with the advice and consent of the Senate. The Governor shall initially appoint, from a list of names submitted by the South Dakota Board of Education pursuant to section 2 of this Act, one nonvoting student member who is a junior in high school for a term of two years and one nonvoting student member who is a senior in high school for a term of one year. Thereafter, the Governor shall annually appoint, from a list of names submitted by the South Dakota Board of Education, a nonvoting student member who is a junior in high school for a term of two years. If a vacancy occurs among the nonvoting student members, the Governor shall appoint a new member to serve out the unexpired term

from among a list of names submitted by the board that, if possible, contains the names of students who had previously applied for membership on the board and were recommended by the board, but not appointed to serve. The terms of office for each voting member shall be four years and shall terminate December thirty-first of the fourth year.
     Section  2.  That chapter 1-45 be amended by adding thereto a NEW SECTION to read as follows:

     Any student, with the consent of the student's parent or guardian if the student is a minor, in grade ten may apply to the South Dakota Board of Education to serve as a nonvoting student member during the student's junior and senior years in high school. The board shall promulgate rules pursuant to chapter 1-26 establishing the application procedures and timelines, and the criteria that the board will use to select the applicants whose names will be forwarded to the Governor for consideration. In selecting applicants to recommend to the Governor, the board shall consider an applicant's academic record and participation in extracurricular activities and community activities.
