         FOR AN ACT ENTITLED, An Act to  establish certain notification requirements related to the use of Roundup Ready alfalfa.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
     Section  1.  No person may plant glyphosate-resistant alfalfa, also known as Roundup Ready alfalfa, unless the person notifies the Department of Agriculture of the location where the alfalfa is to be planted. The person shall notify the department at least two weeks before the alfalfa is planted. The notification shall include a legal description that specifies the section of land in which the alfalfa is to be planted and the number of acres to be planted. The department shall promulgate rules pursuant to chapter 1-26 to specify notification methods and requirements and to establish forms to be used in the notification. The department shall make the notification forms, instructions, and informational material available to any business or other entity that sells or otherwise supplies glyphosate-resistant alfalfa to the public.
