FOR AN ACT ENTITLED, An Act to
restrict the use of garnishment to collect stale judgments.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 21-18 be amended by adding thereto a NEW SECTION to read as follows:

Section 1. That chapter 21-18 be amended by adding thereto a NEW SECTION to read as follows:
No creditor may garnish the earnings of a judgment debtor to collect a judgment if the
judgment is more than ten years old unless the creditor has made at least one bona fide, good
faith attempt to collect the judgment by some means other than garnishment during the
preceding six-month period.
