FOR AN ACT ENTITLED, An Act to
repeal certain provisions regarding the treatment of
Indian tribes for purposes of unemployment insurance.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That § 61-6A-1 be repealed.
61-6A-1.
For the purposes of §§ 61-6A-1 to 61-6A-14, inclusive, the term, employer,
includes any Indian tribe for which service in employment as defined under Title 61 is
performed. The term, tribal unit, means subdivisions, subsidiaries, or business enterprises,
wholly owned by an Indian tribe.
Section 2. That § § 61-6A-2 to 61-6A-14 , inclusive, be repealed.
Section 3. Notwithstanding any other provision of law, any person who was receiving unemployment benefits prior to the enactment of chapter 61-6A shall be deemed eligible to receive those same unemployment benefits on and after July 1, 2007.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That § 61-6A-1 be repealed.
Section 2. That § § 61-6A-2 to 61-6A-14 , inclusive, be repealed.
Section 3. Notwithstanding any other provision of law, any person who was receiving unemployment benefits prior to the enactment of chapter 61-6A shall be deemed eligible to receive those same unemployment benefits on and after July 1, 2007.
