FOR AN ACT ENTITLED, An Act to
authorize the Board of Regents to convey a tract of land
in Pennington County to the United States Air Force and to declare an emergency.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. The Board of Regents may contract with United States Air Force to allow it to acquire a site for its use from within a tract presently owned by the State of South Dakota for the use and benefit of the South Dakota School of Mines and Technology and described as follows: Lot H2 of Lot C of Government Lot 3 of Section 31, Township 2 North, Range 9 East, of the Black Hills Meridian, Box Elder, Pennington County, South Dakota.
Section 2. The Board of Regents may contract for the gratuitous transfer of the site selected by the United States Air Force, subject to a reservation of mineral rights as required by S.D. Const., Art. VIII, § 19, or the Board of Regents may contract for an exchange of mineral rights with federal authorities if the mineral rights received are of value approximating that of the rights conveyed to the United States Air Force and if the total value of the sum of all mineral estates presently owned by the state is not diminished by the exchange.
Section 3. The conveyance authorized by this Act shall be effected as provided in § 5-2-11.
Section 4. Whereas, this Act is necessary for the support of the state government and its existing public institutions, an emergency is hereby declared to exist, and this Act shall be in full force and effect from and after its passage and approval.
