FOR AN ACT ENTITLED, An Act to
revise the tax credit for certain renewable resource
energy systems.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That § 10-6-35.10 be amended to read as follows:
10-6-35.10.
A
No
property tax assessment credit may
not
be used for systems which produce
energy for sale to persons other than the owner of the real property on which the system is
located
, unless the system is a biomass renewable resource energy system using an anaerobic
digester
.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That § 10-6-35.10 be amended to read as follows:
