FOR AN ACT ENTITLED, An Act to revise certain provisions relating to appeals to county
boards of adjustment.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That § 11-2-56 be amended to read as follows:
11-2-56. An appeal to the board of adjustment or any court on a question governed by this chapter stays all proceedings in the action appealed from, unless the officer from whom the appeal is taken files a certificate that by reason of facts stated in the certificate a stay would in the officer's opinion cause imminent peril to life or property. In such case proceedings may not be stayed other than by a restraining order which may be granted by the board of adjustment or by a court of record, on application, on notice to the officer from whom the appeal is taken and on due cause shown.
