FOR AN ACT ENTITLED, An Act to apply certain penalties regarding damages, tampering,
and malicious acts to certain railroads that carry passengers.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:

Section 1. That chapter 49-16A be amended by adding a NEW SECTION to read:
The provisions of §§ 49-16A-107 and 49-16A-108 apply to a tourist railroad carrier. A
tourist railroad carrier is any person who is engaged in the business of selling tickets or
admission to transport passengers by rail in this state primarily as a visitor attraction and the
person owns, leases, or uses a minimum of five miles of railroad track.
