FOR AN ACT ENTITLED, An Act to authorize the use of handguns in the hunting of game
birds.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That ARSD 41:06:04:12 be amended to read:

Section 1. That ARSD 41:06:04:12 be amended to read:
41:06:04:12...Use of rifles and certain handguns to hunt birds prohibited _ Exception for
wild turkeys. The use of rifles and handguns in the hunting of game birds is prohibited.
However A handgun that fires .410 gauge shot shells may only be used by a person who is at
least eighteen years of age in the hunting of nonmigratory game birds. However, no handgun
may be loaded with any ammunition other than shot shells during the time the game birds are
being hunted. In addition, shoulder-held firearms using ammunition which is factory-rated to
produce at least 700 foot-pounds of energy at the muzzle and handguns using ammunition which
is factory-rated to produce at least 500 foot-pounds of energy at the muzzle may be used in the
hunting of wild turkeys. Muzzleloading firearms and muzzleloading shotguns may also be used
in the hunting of wild turkeys.
