        FOR AN ACT ENTITLED, An Act to direct the secretary of education to reinstate scholarship funding under the GEAR UP grant program.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
    Section 1. That the code be amended by adding a NEW SECTION to read:
    Upon receiving approval from the United States Department of Education, the secretary of education shall reinstate the scholarship funding under the Gaining Early Awareness and Readiness for Undergraduate Programs (GEAR UP), as part of the 2011 application for a state grant. The secretary of education shall seek matching dollars for the scholarship funds available to Native American students under the GEAR UP grant program. It is the intent of the Legislature that fifty to seventy-five percent of the total funding received through this grant go toward scholarships for Native American students as is the original intent of the federal law creating the grant program.
