FOR AN ACT ENTITLED, An Act to allow for the promulgation of fees only with explicit
statutory authority.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 1-26 be amended by adding a NEW SECTION to read:

No agency may promulgate any rule to establish a fee without explicit statutory authority
for the fee.
