        FOR AN ACT ENTITLED, An Act to authorize servicemembers to carry a concealed pistol or revolver without a permit.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
    Section 1. That § 22-14-9 be amended to read:
    22-14-9. Any person, other than a law enforcement officer as defined in § 22-1-2 acting under color of authority, a servicemember as defined in § 33-1-1, or any member of the National Guard or any reserve component of the armed forces of the United States, who:
            (1)    Carries a pistol or revolver, loaded or unloaded, concealed on or about his or her person without a permit as provided in chapter 23-7; or
            (2)    Carries a pistol or revolver, loaded or unloaded, concealed in any vehicle while operating the vehicle, without a permit as provided in chapter 23-7;
is guilty of a Class 1 misdemeanor.
    Section 2. That chapter 33-1 be amended by adding a NEW SECTION to read:
    No person may issue or enforce any order, instruction, regulation, or rule that restricts possession, transportation, sale, transfer, ownership, manufacture, or repair of privately owned firearms or ammunition or their components, which are not expressly provided in statute. Any utterances prohibited under this section are null and void.
