FOR AN ACT ENTITLED, An Act to provide certain provisions requiring the official state
seed certification agency to obtain liability insurance.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 38-11 be amended by adding a NEW SECTION to read:

Section 1. That chapter 38-11 be amended by adding a NEW SECTION to read:
Any agency designated to perform various seed classification activities under § 38-11-6 shall
obtain and pay for all forms of liability insurance to protect and assist the agency in meeting any
obligation arising from any act or omission for which the agency may be legally liable. The
liability insurance coverage obtained pursuant to this section shall protect the agency and the
agency's agents or employees in the performance of official duties and against any act
committed by them that reasonably could be considered to be within the scope of their official
duty.
