FOR AN ACT ENTITLED, An Act to rescind previous applications of the State of South
Dakota for the calling of a federal constitutional convention to amend the Constitution of
the United States.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That the code be amended by adding a NEW SECTION to read:

The Legislature finds that it is not, at the present time, desirable to apply for a federal
constitutional convention to amend the Constitution of the United States.

The specific provisions of the following joint resolutions, all making applications for the
calling of a federal constitutional convention, are hereby repudiated and rescinded:
(1) HJR 2, 1907 Legislative Session;
(2) HJR 7, 1909 Legislative Session;
(3) HJR 5, 1909 Legislative Session; and
(4) HJR 503, 1971 Legislative Session.
The repudiation and rescission provided for in this Act is strictly limited to the portions of
said resolutions making application for the calling of a federal constitutional convention and do not apply to the alternative call embodied in the joint resolutions for Congress to propose specific constitutional amendments to the states for adoption.
