FOR AN ACT ENTITLED, An Act to revise the sponsorship and advertising agreements
between certain alcoholic beverage licensees.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 35-2 be amended by adding a NEW SECTION to read:

Section 1. That chapter 35-2 be amended by adding a NEW SECTION to read:
Notwithstanding the provisions of §§ 35-2-6.4 and 35-4-52, a manufacturer, wholesaler, or
an agent of a manufacturer or wholesaler may enter into a sponsorship or advertising agreement
with a retailer licensee if the retailer licensee has on the licensed premises at least one room or
area for which the maximum occupancy approved by the state fire marshal under § 34-29B-2
is at least seven hundred fifty persons.
