An Act to prohibit automatic issuance of video lottery machines to a restaurant operating with a full-service restaurant on-sale license.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That chapter 42-7A be amended with a NEW SECTION:

After June 30, 2024, a business issued a full-service restaurant on-sale license pursuant to § 35-4-111 may only be issued a new video lottery license if the municipality has a video lottery license available. If a municipality has exceeded the maximum number of video lottery licenses, no video lottery license may be issued.

If a business issued a full-service restaurant on-sale license pursuant to § 35-4-111 is operating with a video lottery license prior to July 1, 2024, the business may continue to renew or transfer the video lottery license.
