FOR AN ACT ENTITLED, An Act to revise certain provisions of the alcoholic beverages code.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That § 35-2-6.4 be amended to read:
35-2-6.4.Except as provided in § 35-5-3.2, no No manufacturer or wholesaler licensee
under this title nor any officer, director, stockholder, agent, or employee thereof or any relative
of the licensee, officer, director, stockholder, agent, or employee may be in any way financially
interested, either directly or indirectly, or participate in the operation of the business of any
retailer licensee other than by reason of sales to the licensee. A retailer who is a party to any
action prohibited by this section is guilty of a Class 2 misdemeanor.
Section 2. That subdivision (4) of § 35-4-124 be amended to read:

35-2-6.4.
Section 2. That subdivision (4) of § 35-4-124 be amended to read:
(4) A special off-sale package wine dealers license in conjunction with a special event
within the municipality or county to any civic, charitable, educational, fraternal, or
veterans organization or any licensee licensed pursuant to subdivision 35-4-2(3), (5),
or (12) or any farm winery licensee in addition to any other licenses held by the
special events license applicant. A special off-sale package wine dealers licensee may
only sell wine manufactured by a farm winery licensee;
