Rule 10:01:01:01 Definitions.

          10:01:01:01.  Definitions. Terms used in this chapter shall mean:

          (1)  "Commissioner," the commissioner of administration;

          (2)  "Emergency Vehicle," vehicles of the fire department, police vehicles, and ambulance and emergency vehicles of the state, county, or city or public service corporations;

          (3)  "Intersection," the area embraced within the prolongation of the lateral curb lines or, if none, then the lateral boundary lines of two or more city streets or capitol complex driveways which join one another at an angle whether or not one such street or driveway crosses another;

          (4)  "Capitol complex," the lands owned by the state within the city of Pierre, South Dakota, which are not dedicated to the public for public streets or alleys;

          (5)  "Vehicle," any device in, upon, or by which any person or property is or may be transported or drawn on a public highway;

          (6)  "Official traffic signs," all signs and markings, other than signals, not inconsistent with these rules, placed or erected by the state or officials having jurisdiction for the purpose of guiding, directing, warning, or regulating traffic;

          (7)  "Parking," the standing of a vehicle, whether attended or unattended, upon a driveway or parking area;

          (8)  "Public officers" or "capitol police," the persons appointed pursuant to SDCL 23-3-2;

          (9)  "Driveway," any driveway in the capitol complex;

          (10)  "Parking area," any designated area in the capitol complex which provides parking for a vehicle;

          (11)  "Street" or "avenue," any street or avenue in the city of Pierre, South Dakota that is dedicated to the public use;

          (12)  "Traffic," any movement of a vehicle while using any driveway or parking area;

          (13)  "Careless driving," controlling a vehicle carelessly and without due caution at a speed or in a manner so as to endanger any person or property.

Rule 10:01:02:01 Speed limit.

          10:01:02:01.  Speed limit. The speed limit on any driveway or parking area in the capitol complex is fifteen miles per hour.

Rule 10:01:02:02 Designations of parking areas.

          10:01:02:02.  Designations of parking areas. Parking areas within and near the capitol complex are designated as follows:

          (1)  Parking area A: the parking lot behind the museum;

          (2)  Parking area B: the parking lot behind buildings one and two, also known as the Anderson Building and the Foss Building;

          (3)  Parking area C: the parking lot east of building two, also known as the Foss building;

          (4)  Parking area D: Ree Street;

          (5)  Parking area E: Capitol Avenue;

          (6)  Parking area F: the driveway in front of the Capitol;

          (7)  Parking area G: the driveway leading to Nicollet Street;

          (8)  Parking area H: the parking area designated "right turn only" north of the Capitol;

          (9)  Parking area I: the parking area designated "left turn only" north of the Capitol;

          (10)  Parking area J: the parking lot north of the health laboratory;

          (11)  Parking area K: the parking lot north of the Capitol and south of Broadway Avenue;

          (12)  Parking area L: Nicollet Street;

          (13)  Parking area M: Broadway Avenue;

          (14)  Parking area N: Wisconsin Street;

          (15)  Parking area O: the parking lot north of the Department of Transportation Building;

          (16)  Parking area P: Illinois Street;

          (17)  Parking area R: the parking lot south of building three, also known as the Kneip Building; and

          (18)  Parking area S: the driveway west of the State Library and the parking lot south of the State Library.

Rule 10:01:02:03 Overnight and 24-hour parking.

          10:01:02:03.  Overnight and 24-hour parking. Vehicles may not be parked overnight in parking areas H, C, B, F, G, H, I, and J. Vehicles left in the parking areas overnight or for more than 24 hours shall be parked in the areas designated, city streets and avenues excepted:

          (1)  For area C: east of building two, also known as the Foss building, north and south perimeters only;

          (2)  For area K: north of the Capitol on the north side along the curb extending east to the center sidewalk;

          (3)  For area O: along the north end of the lot nearest Church Street;

          (4)  For area R: the west side of the lot from the 30-minute zone south;

          (5)  For area S: the northeast corner of the south parking lot.

Rule 10:01:02:04 Traffic signs.

          10:01:02:04.  Traffic signs. Any entrance, exit, parking area, no parking zone, no parking fire lane, left and right turn only intersection, one way drive, do not enter intersection, timed parking zone, and any other place controlled by directional sign or marker shall be posted with the appropriate traffic sign. The Bureau of Administration shall designate any timed parking zone.

Rule 10:01:02:05 Parking violations.

          10:01:02:05.  Parking violations. Parking in any of the following ways is prohibited:

          (1)  So as to obstruct any crosswalk;

          (2)  On any lawn, curb or sidewalk;

          (3)  Along any driveway which is signed "no parking fire lane" or "no parking this side of driveway" or along a yellow curb;

          (4)  In front of a fire hydrant;

          (5)  In a "no parking area";

          (6)  In a construction zone;

          (7)  In front of any removable barrier;

          (8)  So as to obstruct traffic;

          (9)  In double or multiple form (straddling a line);

          (10)  For a longer period than designated in a timed zone;

          (11)  In a "reserved for handicapped" space by any person who is not handicapped or other reserved space by any person other than the person for whom the space is reserved;

          (12)  On a concrete island;

          (13)  In any area blocked off by a permanent or temporary barricade;

          (14)  Double parking;

          (15)  Parking the wrong way on one way drives; and

          (16)  Parking more than twenty-four hours in other than designated areas.

Rule 10:01:02:06 Moving violations.

          10:01:02:06.  Moving violations. Driving a vehicle in any of the following ways is prohibited:

          (1)  Careless driving;

          (2)  Driving the wrong way on a one way street; and

          (3)  Driving around, over or through a permanent or temporary barricade.

          10:01:02:07  Vehicles in Hilger's Gulch. Driving a vehicle on the lands owned by the state in Hilger's Gulch is prohibited.

Rule 10:01:03:01 Vehicles subject to impoundment.

          10:01:03:01.  Vehicles subject to impoundment. Any vehicle parked in violation of this article will be subject to impoundment. The vehicle will remain impounded until owner pays towing and impoundment costs.
