Rule 41:01:01:02 Appointment of hearing officer.

          41:01:01:02.  Appointment of hearing officer. If a hearing is held pursuant to SDCL 1-26 the commission may appoint a hearing officer to conduct the hearing. The hearing officer shall submit all filings and a condensation of the pertinent evidence and positions presented at the hearing, together with recommendations, to the commission at the commission's next regular meeting. If a person requests in writing that a verbatim record be made of the hearing, an audio recorder may be used.

Rule 41:01:02:01 Definitions.

          41:01:02:01.  Definitions. As used in this title:

 

          (1)  "Commission" means the game, fish and parks commission;

          (2)  "Department" means the Department of Game, Fish and Parks;

          (3)  "Secretary" means the secretary of the Department of Game, Fish and Parks;

          (4)  "State Park System" includes state parks, state recreation areas, state nature areas, state lakeside use areas, the George S. Mickelson Trail, historic prairies and all associated structures; and

          (5)  "Water Access Areas" includes lake access areas and fishing access areas as designated by the department.

HABITAT CONSERVATION EMBLEMS

    41:01:03:01.  (Effective March 1, 2025) Fees established. The department shall assess a fifty-dollar fee for each habitat conservation emblem set purchased pursuant to SDCL 32-5-197. A thirty-dollar fee must be assessed for each habitat conservation motorcycle emblem.
